Yann Geron

In more than three decades of practice, Yann has developed a strong track record and reputation as a fiduciary and in service of a variety of clients and interests in bankruptcies, out-of-court restructurings, liquidations, and assignments for the benefit of creditors. Between 1993 and 2005, Yann ran his own bankruptcy boutique which he then merged into a national law firm, where he served as co-chair of the firm’s Financial Restructuring & Bankruptcy Department, as a member of the firm’s governing body for eight years, and as the first managing partner of the firm’s New York office, which he launched and grew to nearly 60 attorneys before rotating off of his management duties.

In 2021, Yann decided to return to his legal roots and started his own elite bankruptcy boutique. Yann has served with distinction as a member of the Panel of Bankruptcy Trustees for the Southern District of New York (Manhattan) since 1993. In 2020, Yann was appointed to the newly formed panel of Subchapter V trustees for Region 2. In addition to his own trustee matters, Yann has represented a number of other panel and non-panel trustees in New York and other jurisdictions and has handled and supervised countless litigations and matters in the bankruptcy, district and state courts. Yann also serves as windup officer in voluntary out-of-court liquidations. Yann is a member of court-approved mediators for the Bankruptcy Courts for the Southern and Eastern Districts of New York.

Nicole Santucci

Nikki has developed a broad practice that is built on her acute understanding of the complex issues and pressures her clients face while navigating the bankruptcy process. She has significant experience in representing trustees and other fiduciaries, debtors, and creditors in all facets of Chapter 7 and Chapter 11 proceedings and bankruptcy liquidations, including asset recovery and liquidation; claims review and analysis; settlement negotiations; prosecution and defense of avoidance claims; and bankruptcy-related litigation.

Nikki regularly acts as a liaison between trustees, debtors, and creditors on matters concerning bankruptcy estate administration, offering guidance and counsel on all aspects of a case from its commencement through closing. She also has experience representing appointed fiduciaries in state court assignments for the benefit of creditors and creditors in bankruptcy and insolvency proceedings.

  • Thelen LLP (SDNY), former national law firm. Represented the Chapter 7 trustee. Played a crucial role in resolving the majority claims against former partners without litigation. Addressed novel issues that included developing protocols for the return of client escrow funds and addressing WARN Act claims and unfinished business claims.

    Dallek, Inc. (SDNY), former furniture retailer and interior design company. Represented the Chapter 11 trustee. Assisted in developing and drafting sale protocols for the debtor’s assets located in a warehouse located in Bronx, New York which sold at auction for significantly above the stalking horse bid. Helped construct and confirm a plan of liquidation that paid creditors 100 percent of their claims plus interest.

    Gladys Smith, Inc. (SDNY), former owner and manager of real property located in New York, New York. Represented the Chapter 11 trustee. Assisted in successfully resolving claims asserted by and against the debtor and the purchaser of the debtor’s real property. Successfully reduced claims filed against the estate by over $2.6 million. Helped construct and confirm a plan of liquidation that paid creditors 100 percent of their claims plus interest.

    Pali Capital Corp. and Pali Holdings, Inc. (SDNY), former broker-dealer. Represented the Chapter 7 trustee. Assisted with the successful prosecution of claims against the debtor’s former officers and directors that resulted in a multimillion-dollar recovery for the bankruptcy estate.

    Rodman & Renshaw, Inc. (SDNY), former-broker dealer. Represented the Chapter 7 trustee. Lead liquidation efforts that resulted in more than $5 million in recoveries for the bankruptcy estate.

    Addressed a host of bankruptcy-related issues, including contract assumption and rejection issues, third party document demands, surrender of collateral belonging to secured creditors, and liquidation of tangible assets and intellectual property.

    Sun Property Consultants, Inc. (EDNY), former owner and operator of a shopping center located in Long Island, New York. Represented the Chapter 11 trustee and Chapter 7 trustee. Assisted with the management and operations of the debtor’s business. Assisted with the marketing and sale of the debtor’s real property. Motion practice and settlement negotiations regarding whether a forfeited contract deposit represented collateral of the senior secured creditor.

Jeannette Litos

Jeannette represents parties in a variety of roles in Chapter 7 and Chapter 11 consumer and business bankruptcy cases with a focus on representing bankruptcy fiduciaries. She regularly acts as counsel to trustees, consumer and corporate debtors, plan administrators, secured and unsecured creditors in the Southern and Eastern Districts of New York, as well as secured creditors in Chapter 13 cases. The breadth of her experience makes her uniquely qualified to understand the complex issues and pressures her clients face while navigating the bankruptcy process.

In addition to her experience in bankruptcy proceedings, Jeannette also has experience representing appointed fiduciaries in state court assignments for the benefit of creditors, and clients interested in informal business wind-ups as well as formal corporate dissolutions.

Jeannette is fluent in Spanish.

  • Chelsea Craft Brewing Company, LLC (SDNY), former craft brewery in Bronx, NY. Represented the Chapter 11 trustee and Chapter 7 trustee. Successfully operated and sold the debtor’s business and assets.

    Sun Property Consultants, Inc. (EDNY), former owner and operator of a shopping center located in Long Island, New York. Represented the Chapter 11 trustee and Chapter 7 trustee. Helped manage and operate the debtor’s business prior to ultimate sale of debtor’s real property. Successfully argued that the forfeited contract deposit represented collateral of the senior secured creditor resulting in a distribution to creditors.

    Rodman & Renshaw, Inc. and Direct Markets Holding, Inc. (SDNY), former-broker dealer and parent. Represented the Chapter 7 trustee. Successfully liquidated more than $5 million in stocks resulting in 100% distribution to creditors and surplus to parent for further distribution to its creditors.

    PBS Foods, LLC (SDNY), former renowned bakery. Represented Chapter 7 trustee. Successfully defeated appeal seeking to unravel bankruptcy settlement.
